OSU Wireless-Cellular
Terms and Conditions for Personal Use Customers

Agreement for OSU Wireless-Cellular Service:
OSU Wireless-Cellular is a service of OIT, a department of The Ohio State University. This is a personal-use agreement for OSU Wireless-Cellular service between the party whose name and signature appears on the order form located on the reverse side of this document (the subscriber) and OIT located at 320 W. 8th Avenue, Columbus, Ohio 43201.

Term:
The term of this agreement is effective upon activation of the cellular telephone number(s) listed on your OSU Wireless-Cellular Personal Agreement. As the subscriber, you agree to a minimum period of two (2) years. This agreement will remain in effect for the duration of the minimum term. Periods of suspension of service do not count towards your minimum term.

Eligibility:
This service is available to all current Ohio State University employees and students. If you cease to be employed by, or if you are no longer a registered student of The Ohio State University, then you are no longer eligible for this service. Additionally, you must be 18 years or older to order and use OSU Wireless-Cellular service. As the person signing this agreement, you are considered the subscriber and primary user of service and will remain responsible for all charges incurred under this agreement. This OSU Wireless-Cellular agreement cannot be transferred to another party.

Credit Check Consent and Reporting Authorization:
By signing this agreement, you authorize and instruct any person, consumer reporting agency or credit reporting agency to complete and furnish to OIT and its service providers any information it has on you. You authorize OIT and its service providers to disclose information related to your account, including confidential information and payment history, to credit reporting agencies or private credit reporting associations. You are hereby notified that a negative credit report reflection on your credit report may be submitted to a credit agency if you fail to fulfill the terms of this agreement. Additionally, you are required to have a major credit card (American Express, Visa, MasterCard or Discover Card) to order OSU Wireless-Cellular service. If there is insufficient information about your credit, six (6) months of prepaid service will be required up front.

Account Credit Limit:
The monthly credit limit for your OIT account is based on your credit check and eligibility status.

Service Provisions:
Neither the providers of services to OIT, nor OIT or The Ohio State University shall have any liability to any failure or disruption of services provided hereunder, regardless of the form of action, whether in contract or in tort or otherwise. You shall not be deemed a third-party beneficiary of any contract between OIT and OIT’s service providers. Coverage is not available everywhere. Click here for approximate coverage information.

Rates and Charges:
You agree to pay all applicable charges during the minimum term. Such charges include, but are not limited to: activation fees, monthly access charges, feature charges, airtime charges, toll charges, roaming charges, data and internet charges, universal service charges, directory assistance fees, taxes, cancellation charges, and any other applicable charges as may apply. Different service rates and fees may apply when roaming outside of your service plan’s area and on another carrier’s network. All phone usage, including incoming and outgoing calls use minutes. Unused plan minutes do not carry forward. International roaming rates will vary. On a call that crosses time periods, minutes are deducted or charged based on the start time. Calls are rounded up to the next whole minute.

Billing:
Your bill reflects the fees and charges in effect under your calling plan at the time they are incurred. You can dispute your bill, but only within 180 days of receiving it. You must still pay any disputed charges until the dispute is resolved. Charges may vary depending on where your wireless phone is when a call starts. If a charge depends on an amount of time used, we will round up any fraction of a minute to the next full minute. Time starts when you first press SEND or the call connects to a network on outgoing calls, and several seconds after you press END or the call otherwise disconnects. Most calls you make or receive during a billing cycle are included in your bill for that cycle. Billing for airtime (including roaming) and related charges may, however, sometimes be delayed. Delayed airtime may be applied in the month it appears on your bill against airtime included in your calling plan for that month, rather than against the included airtime for the month when you actually made or received the call. This may result in charges higher than you would expect in the later month. Additional data/internet charges may apply if used without a data/internet plan.

Service Changes:
OIT can change, modify or amend this agreement at any time by sending you written notice. If you do not agree with the changes and wish to cancel service, you must notify OIT Office in writing within 30 days of receiving any written notification and pay any outstanding charges. Any service changes you request including service termination must be made to OIT in writing. No verbal change requests will be accepted. Cancellation fees and other charges may apply.

Cancellation Fee:
You will be responsible for a cancellation fee for each phone/line of service that is terminated early. Cancellation fees may vary depending upon the plan that you select. Please refer to the Early Termination Fee statement provided on your OSU Wireless-Cellular Personal Agreement. Payment of cancellation fees does not satisfy other charges owed; you are responsible for all outstanding charges on your OIT account.

Suspension and Termination of Service:
OIT reserves the right to suspend or terminate service without prior written notice. If your service is suspended, monthly service fees still apply and you are responsible for paying your OIT account in full upon receipt each month.

Renewal of Service:
At the completion of the minimum term, and if you are still a current student or employee of The Ohio State University, your service may be renewed on the same service plan on a month-to-month basis until you inform us in writing to change or disconnect your service.

Changing Service Plans:
You may change to another available service plan, offered by the same OSU Wireless-Cellular service provider as long as the minimum term for the new plan is equal to or greater than the original minimum term of the previous plan. Special promotion plans may be subject to different terms and conditions. All plan changes may be subject to additional charges.

Adding Additional Phones/Lines of Service:
A new service plan with a two-year minimum term agreement is required for each additional phone/line of service added (Secondary Phone/Line). The first phone activated on the service plan (Primary Phone/Line) and Secondary Phones/Lines may have different term commitment end dates. If the Primary Phone/Line on the account is terminated prior to the term expiration date of any Secondary Phone/Line, a Secondary Phone/Line must move to the Primary Phone/Line position.

Numbers:
Your OSU Wireless-Cellular telephone number(s) is assigned by OIT and The Ohio State University; you shall not acquire any proprietary interest in this number(s) except if allowed by law.

Warranty on Equipment:
The warranty period for any cellular telephone purchased or provided through OSU Wireless-Cellular is subject to the terms and conditions of the manufacturer. The warranty is not transferable.

Risk-Free Guarantee:
If you are unsatisfied in any way with your OSU Wireless-Cellular service or equipment, you can terminate service and this agreement within 14 days of the new activation without paying a cancellation fee. You will be required to return your complete, undamaged equipment within the first 14 days of new service activation if you choose to utilize the Risk-Free Guarantee. You will still be required to pay all charges owed based on actual usage including partial monthly service fees, taxes and surcharges.

Lost and Stolen Equipment, and Unauthorized Use of Service and Equipment:
You must make every effort to safeguard your OSU Wireless-Cellular service and equipment from unauthorized use. You are responsible for notifying OIT to deactivate your service immediately if you suspect misuse, or if your equipment is lost or stolen. If fraudulent use is suspected by OIT or The Ohio State University, this service may be suspended or terminated at any time. In the event that your OSU Wireless-Cellular equipment is lost or stolen, you as the subscriber are responsible for the terms and conditions of this agreement, as well as the purchase price of any replacement equipment.

You are also responsible for any usage prior to reporting any lost or stolen OSU Wireless-Cellular equipment. Please use the information provided in the next section to report lost or stolen equipment.
